It is not a matter of opinion. A disability is a mental or physical condition in one or more performance domains that adversely affects educational performance. Note: When considering whether instruction and interventions are sustaining a child's progress and level of performance, include consideration of outside supports provided or obtained by the parents or guardians.
Additional information on considerations for determining disability, please refer to Key Considerations for Determining a Disability. To be eligible for special education, a student with a disability must need specially designed instruction SDI to meet disability-related needs. This component of eligibility is met when the child needs adaptations to the content, methodology, or delivery of instruction:.
Teams must consider all disability-related needs in determining if specially designed instruction is needed. Additional information on considerations for determining need, please refer to Key Considerations for Determining a Need for Specially Designed Instruction.
If the team determines that a child has a disability and, by reason of that disability, needs special education and an exclusionary factor is not the determinant factor, the team must identify the child as an eligible individual. Teams are required to follow all comprehensive evaluation procedures as noted above as well as the below additional requirements. This is because labels, standing alone, do not provide parents and educators with information regarding instructional needs. This is also because labeling may be the basis for inappropriately restrictive placement decisions.

Accessibility Statement. Press Releases. Specific Learning Disability: This means that if a disorder is severe, the IEP team can determine that a child needs special education services. Many districts use the "Other Health Impaired" category for these types of situations. Consequently, determining if a child is eligible is not cut and dry. It really depends on the child and their specific situation.
Fortunately, IDEA was written to support this flexibility. The initial evaluation report is used to determine what special education and related services the student needs. The assessments should provide the district with functional, developmental, and academic information about your student.
If the district needs assessments from outside sources in order to conduct a comprehensive evaluation, such as medical or neurological information, it must ensure the outside assessments are conducted by qualified providers. You are not required to obtain and provide the school district with a medical diagnosis for your student in order for a district to evaluate your student for special education.
A medical diagnosis is also not required in order to be found eligible for special education services. The school district, however, may request that you provide any medical information you may have as part of the referral process and may, if necessary, seek your consent to obtain a medical statement or assessment indicating whether there are any other factors that may be affecting your student's educational performance as part of any district evaluation.
The requirements for determining whether a student has a Specific Learning Disability can vary by district. School districts are not required to use RTI.
The district has the option of using either the severe discrepancy model or RTI procedures in making a determination about specific learning disabilities. If you or an adult student revokes consent, in writing, for the continued provision of special education and related services, the district must honor the revocation and provide you with Prior Written Notice identifying the date the district will stop providing services.
